The HL Files: The Conclusion

Those of you that have been following the discussions in the comments section of my previous post know that I received two emails from Superhandz (De’vo) in which he asked me to remove the content concerning these files because what’s in them is protected with copyright of his company.
I’ve been told not to publish these two emails (and I won’t) but I’ll sum them up for you to understand my position:

He said that I commited ILLEGAL acts against himself and his company and told me to delete them or I would be in BIG trouble.

He told me that he retirieved my personal information and my website server’s and he would take actions against me if I didn’t do what he said.

He’s been kind enough to let me rectify with time because he said he would normally have had my site shut down first and go after me in court.

As for now i have removed the link to the podcast’s episode 2 because there where some screens of the saved forum pages which he claimed to have the copyright to.
After some days of deliberation and talking to many people directly involved in this issue as well as others who have been ruling blogs and websites for years and have had enough experience with laws, copyright, privacy and security over the internet, I’ve finally come up with a decision.
As a blogger, I’m not going to host or promote these files in any way and won’t even say if they are, in fact, real or fake. I’ll keep this information for myself and my private conversations with other people in a different place than a forum, because I’ve learned with this that the internet is not a place to keep your privacy intact.
However, for those of you that might think I’m backing out, I want to let you know that my job in this field has been succesfuly completed.
Since the beginning, my main motivation was to share with my readers, both new and old, that there are some Handlordz saved webpages and files regarding the behaviour of the, as they like to call him, XCM Leader De’vo vom Schattenreich, that have been leaked and are in the hands of many people now.
I, as a blogger, never shared in public if I support what is in them or if they have been edited or left intact. I don’t have the files in other place than in my head for what I’ve read in them, somewhere, somehow. And, as I said, they won’t be posted in this blog to respect the laws.
However, as I also said, my job is complete up to this point because the information about the existence of these files has been made public and now NO ONE can stop them from being spread all over the internet.
I’m sure you won’t see any link to them in the blogs or forums, but there will always be illegal or alternative ways of sharing them like p2p networks, public file hostings like rapidshare, megaupload, zshare, yousendit… public chatrooms, private msn conversations, emails, PM’s at places like myspace and facebook and so on.
I don’t need to suggest, nor will I, for people to start sending these files around because I know this will be automatically done.
So, as a human being and card flourisher, I’ve learned a lot through this experience and now I know who to trust and who to give my money to in the future.
There will be no more posts about Superhandz / Handlordz unless I’m told to publish them by the staff and I won’t make any reviews or free advertising of their products or events as I’ve been doing for other companies.
If they want to stay apart and don’t want to see us all united, that’s fine with me – it’s their loss.
I want to give big thanks once again to all of you that participated, HLers or not, for sharing your opinions and being so kind and respectful. You have my regards, and I’ll keep praying for a united world for our beloved Art.
I’ll leave the comments open here and I hope you guys understand my position.

Holding copyright on forum posts is even more ridiculous than holding copyright on a member’s video and removing it off youtube even thought the member (Andrei, if you haven’t figured out) is okay with it being on youtube.

Why did you ask ? You dont think really anyone will hunt you or bust you for publishing what they said in ther own forum.There is no copyright.There is nothing like you are a criminal if you publish this. Everyone out there leave the HL/SH comunity before its to late. Things changed , whats happining there is not good for the comunity.

Well, I don’t really know why there was this hughe rush about these leaked HL files, since I don’t know what exactly was in there, but of cource this is a good thing you didn’t broke the copyright and privacy rules, although the “important” (?) information will never be read here now. But, as you mentioned in this post, there will always be methods to get these files, no matter what… I think you made the right decision by not posting them now.
Ah well, let’s for get this stuff and just have a Happy Birthday, Alejandro ;)

I remember seeing things like this in politics.
Politicians often mail about plans and stuff and maybe they also mail about which people they like and don’t like. Simply talking about people behind their backs.
Now I remember several cases where mails like this had come out to the public and sure the policians got mad, but they didn’t go to court. Why? Because there are no way they would win. You simply can’t copyright information like this.
You can’t copyright a post in a forum.
People are posting in forums to express their opinion and the owner of this forum can’t say that the posts made a protected by copyright laws since they are simply people expressing their opinion. Its not a product they are releasing. Its an opinion!
I still think you should have posted them just to make it clear that you/we are not afraid of De’vo.
Anyways I will keep spreading them around so if someone wants them just contact me!

If he’s claiming the images and design of the files to be copywritten (which they might very well be), how about simply publishing the text?
Simply quote what’s written on the forums. Or what about simply print screening the posts, scribbling over the forum-images (which De’vo didn’t create anyway, but his fellow members who are long-banned :S).
Seriously, what is he claiming to have copywritten?
He can talk big, but I don’t think he’d bring you to court. For starters I don’t think they allow people to wear cloaks there, so do you think he’d give his identity away for something like this?
He’s just trying to scare you into not posting it, and he’s probably wanting those emails out of public since they probably won’t hold in the eyes of people more involved in legal issues, who know he’s got nothing on this one.

After reading this, go check what it says at the top of the forums at HL and you’ll have your answer as to whether or not it’s copyright infringement to post up those files…not that most of you kids care or even understand what’s involved both monetarily and time wise with a legal proceeding concerning copyright infringement.
Educate yourselves before posting up stupid comments about the material not being copyright or “it’s just the images, you can post the text”. Now get up from your computers and go play outside!

Wow. Really. HL doesn’t even diss on D&D or D+M like this. I think this is just a little bit backwards, considering that YOU were trying to release OUR (HL) file, you’d really think tht we’d be hurling the insults and calling names, not the other way around. Shows just how insecure you guys are. Honestly why did you want the files in the firt place? So you could feed your hatred? I mean when was the last time HL seriously insulted your communities? This is just a personal thing you have against us. I think I’ve handled this fairly maturly up to this point, unlike some who still trash talk us without reason, besides a personal dislike of HL.

Acctually, I do have the files I downloaded them when they were still on DKN but that was 2005, three years ago, my questions was when was the last time HL insulted the other communities, if the files are the only thing you can point out, then it seems to me 3 years is a long time to go without insults, Unlike some who take every oppourtinity to trash talk us and ATTEMPT to bring us down. And a small fyi…. I read every ounce of info on those files, but It hasn’t changed my mind about HL one bit, if anything I love HL even more now, As for De’vo and his mods…. these beatches are the Fuckin coolest guys ever! And still (even after reading the files) they are some (out of the few) of the most skilled, friendliest and most hospitable dudes I’ve known. And for the record, I did not download the files in the first place the get dirt on De’ or to find things wrong with HL, I did it to build my knowledge of my community and to give them a voice when DKN started laying on the insults, and In doing so I’ve gained tons of technical info (no not phone numbers)….
Also think, if you were to find hidden conversations on DKN or T11 (or your own community) that gave them a negative image in the eyes of HL, would you think of them any less? Even if you had posted up the files, It wouldn’t have had the outcome you had hoped for, NOTHING can take HL or SH down, not these files nor any other bull you might make up or find, as of now we still are going strong as ever as we have been for many years.

well yes … on some of the files the post are as recent (as far as i recall) as December of 2007… as for the copyright thing .. still wouldnt trust a single website as the basis for this being a fact… to be 100% sure i would have to talk to a legal aid that is familiar in cases like this .. but thats just me… i mean in that link alone there is a loop hole .. someone could just read the saved pages, create text files of each one with a summarization of the text and publish that without infringing the copy right.. but when doing that ppl would say that text files are not true because it has been taken out of context .. and which is why it is more believable to see the posts in their original formate (the saved forum pages)…as for me the saved pages only re-enforced what i already new to be fact…
As far as i know DN doesn’t have any hidden forums with the exception of the “mod forum” which is only there to protect the members from public prosecution when someone has made a comment that was deleted, or a person was warned for an action.. no where in there is there any trash talking of any kind toward members of that or any other forum.

hmm, to be honest, I think publishing these files would have been 10 steps lower than anything De’vo has done.
For those that have campaigned so tirelessly (and may continue to do so) to get this stuff out there- it seems to me that the most relentless people were banned from HL, possibly unfairly, they now have major grudges and spend half most of their time whinging about De’vo.
All they have done is let us know how badly they have been affected by De’vo. So you lose I’m afraid.

Also, for the same people who have tried so publically to ‘out’ De’vo, I very much doubt people will want to share personal information with you in future. Just in case you fall out over something trivial and you start acting like 6 year olds again.
Whats more clear to me is the people who rose above this shit and stayed out of it. Props to those guys, they are the secure individuals who value integrity above revenge.

Kevin Ho was banned from Handlordz for sticking up for Jonas.
Jaspas was banned from Handlordz because they thought he, Daren and Daryl were the same person.
Bone and Richard, who did so much for the site and its introduction to mainstream audiences, were banned at the drop of a hat because De’vo didn’t want TCC and Decknique to get bigger than HL.
And finally, Karen and Jessica, the girls who did the ‘West End’ video, were publicly insulted by HL members who thought they were ‘Singaporeans pretending to be girls’.
These are many of the things HL has covered up over the years, and unless more people find out what really happened, it’s going to happen all over again.

It was aris disrespecting by insinuating that “our artists kick HL asses!” which is totally false, not that singaporeans are bad at XCM/”cArdistrie” (a couple are very awesome and I respect them for their original stuff, unlike some KK who just do D&D cut and nothing else) it just that they wouldn’t kick ass because the styles are different and any type of battle would be hard given the differences between XCM and “cArdistrie”. But this is a kinda pointless discussion as menik brought up, sure you guys continue squabling amongst your selves, I’ve got some better stuff to do. That’s his “sincere” apology. I find it odd that he wants to rectify the situation with Dan and Dave, Richard, Andrei etc. but doesn’t want people to see exactly what he did wrong. In mymind he’s arrogant and selfish. He tries to manipulate people like he manipulates his cards. As long as Mr.De’vo comes out on top and looks good. He, in my opinion, takes everything way over the edge. The is no Xtremz cARd wArZ111. He’s a card manipulator that needs to get over himself. I’d like to see him suit up and fight a real war where people are dying. Maybe then I will have respect for him.

Suhel, of course one can be better at something than it’s creator…
I’ve seen many people do De’vo’s stuff better than De’vo.
He is very original but he sure isn’t the best and he should learn to accept that.
Now, for the guys you said that perform De’vo’s stuff, I surely dissagree here. Andrei’s just put’ out a vid full of new concepts and Virt’s are comming out with a DVD full of their original stuff.
Also, even De’vo was inspired by Tudor and Kenner (a magician!). The way I see it DnD, DM and De’vo are quite similar originallity wise but they do have different styles and a different attitude and it’s well know that that last thing is De’vo’s problem…
…and that’s the point of this thread, it’s not about how good or original someone is. It’s up to you to create new stuff, not to act like a fanboy and defend people who should basicaly defend theirself by creating new material…respect has to be earned you know, and it can be just as easily lost.
It’s obvious that we have a different perspectives about it as I dissagree with most of the things you’ve said, one thing I do agree with you about is your music taste…
I’m very curious about two things tho:
-Have you seen the files?
-For how long have you been a HL member?
Mostly, people who defend HL are the ones that are somehow privileged, others stay neutral most of the time, which I find quite funny.

Great article. There’s a lot of good info here, though I did want to let you know something – I am running Fedora with the circulating beta of Firefox, and the look and feel of your blog is kind of bizarre for me. I can understand the articles, but the navigation doesn’t work so great.
